U.S. Supreme Court to Hear Case That Could Hurt Pharma Marketing

The states of Vermont, Maine, and New Hampshire are passing laws to make it harder to generate physician prescribing data for purposes of market research and use by pharma companies for marketing purposes.

Bob Ehrlich, Chairman of DTC Perspectives, says: “The case has enormous implications for the drug industry. If a drug company cannot effectively know how detail reps are doing at the individual physician level it will change the way they do marketing. More than that, the whole data and relationship marketing industry for all industries relies on the sale and analysis of target data. If states can make it harder to market to physicians maybe they will try to restrict other forms of marketing that do not fit their policy goals.”
